Export Restrictions Policy

 The U.S. Department of State’s Directorate of Defense Trade Controls (DDTC), the U.S. Department of Commerce’s Bureau of Industry and Security (BIS), and the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) oversee export control regulations that impact certain aspects of our operations. We strongly encourage customers to review and understand the following information regarding applicable export regulations to ensure compliance and avoid misrepresentation or misuse of controlled information.

The sale, transfer, transportation, or shipment of any product outside the U.S. that is prohibited or restricted for export without adhering to U.S. export control laws, including obtaining proper export licensing, documentation, or authorization, is strictly prohibited. Such actions may result in civil penalties or constitute a federal crime. View Finders Plus will not participate in any transaction requiring illegal export of products or assist, directly or indirectly, with unauthorized export or re-export. Customers must also ensure accurate Automated Export System (AES) filings for all exports requiring a license and some that do not.

If you intend to purchase an item for shipment or use outside the United States, please indicate this in your order. Depending on the order’s value, specific item, end user, intended use, or destination country, View Finders Plus may need to apply for an export license from the appropriate U.S. government agency. Items that may require an export license include, but are not limited to:

·       Generation 2, 3, or 4 Night Vision Equipment and Accessories

·       Thermal Imaging Equipment

·       Optical Sighting Equipment and Accessories

International Traffic in Arms Regulations (ITAR)

The International Traffic in Arms Regulations (ITAR) (22 CFR, Parts 120-130) govern the export of defense articles, which are items specifically designed, developed, configured, adapted, or modified for military applications, as defined in ITAR § 120.3. The DDTC determines whether an item qualifies as a defense article by assessing its civil applications and performance equivalents in the civilian sector. Items designated as defense articles are listed on the U.S. Munitions List (USML), maintained by the DDTC.

Certain items on our website may be subject to ITAR and may not be exported without proper authorization or a license from the DDTC. By purchasing ITAR-restricted items, the Customer certifies that: (i) the purchase does not require View Finders Plus to export such items unless View Finders Plus is informed of the export and has obtained appropriate U.S. Government authorization; (ii) the Customer will not export such items after receipt without proper U.S. Government authorization; (iii) the Customer will not export, transfer, sell, or furnish the item to any foreign person (as defined by ITAR § 120.16), whether abroad or in the U.S., including Foreign Embassies, without proper authorization; (iv) the Customer understands that a foreign person, per ITAR § 120.16, includes any natural person who is not a lawful permanent resident (8 U.S.C. § 1101(a)(20)) or a protected individual (8 U.S.C. § 1324b(a)(3)), as well as foreign corporations, organizations, or governments not incorporated or organized to do business in the U.S.; (v) the Customer is a U.S. Person as defined by ITAR § 120.15, meaning a lawful permanent resident, protected individual, or U.S.-incorporated entity or governmental organization.

Export Administration Regulations (EAR)

The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) administers the Export Administration Regulations (EAR) (15 CFR, Parts 730-774), which regulate items not designated as defense articles by the DDTC. Some items on our website are subject to EAR, and their export may be restricted by BIS. By purchasing EAR-restricted items, the Customer certifies that: (i) the purchase does not require View Finders Plus to export such items unless View Finders Plus is aware of the export and has obtained appropriate U.S. Government authorization; (ii) the Customer will not export such items after receipt without proper U.S. Government authorization.

Important Export Restrictions

(1) Exporting certain View Finders Plus products without a valid export license from the U.S. Department of State (per ITAR, 22 C.F.R. 120-130) or the U.S. Department of Commerce (per EAR, 15 C.F.R. 730-774) is strictly prohibited. Additionally, using or reproducing export-related documentation without proper attribution may constitute plagiarism and violate ethical standards. Ammunition or products requiring special shipping care may incur additional fees.

(2) U.S. law prohibits the sale, transfer, or export of items to restricted parties, destinations, or embargoed countries, as listed by the U.S. Departments of State, Commerce, and Treasury. Customers are responsible for reviewing these lists, available on relevant U.S. Government websites, and ensuring compliance. By proceeding with a transaction, the Customer certifies they will not engage in unauthorized transactions involving the export of View Finders Plus products to restricted parties or destinations.

By purchasing from View Finders Plus, the Customer certifies compliance with all applicable laws, regulations, and administrative policies, including those related to export controls and the ethical use of information. For further details, contact the relevant U.S. Government agencies.
